These Terms of Service ("Terms") govern your access to and use of the services, websites, and software provided by Launchpad Websites ("Launchpad," "we," "us," or "our"). By engaging us, requesting a free demo, or purchasing any service, you ("Client," "you") agree to these Terms in full. If you do not agree, do not use our services.
1. Services
Launchpad provides website design, development, hosting, and optional ongoing support services for small businesses. Specific deliverables for each engagement are defined in your selected plan (Spark, Starter, Growth, or Pro) and any written scope provided to you.
2. Free Demo
We offer a complimentary, no-obligation demo so you can evaluate our work before purchasing. The demo remains our property until full payment is received for a purchased plan. You may not copy, reproduce, deploy, or otherwise use the demo or any portion of it without purchasing a plan.
3. Payment Terms
- All build fees are due in full before production begins. Launchpad does not offer installment or split-payment plans; the free demo exists so Clients can evaluate the work at zero risk prior to purchase.
- Optional monthly support fees are billed in advance on the anniversary of subscription and recur monthly until cancelled. No prorated refunds are issued for unused portions of a billing cycle.
- All fees are quoted and payable in USD. You are responsible for any applicable taxes.
- Failed monthly-support payments will be retried by our payment processor. If the payment cannot be collected within 14 days, hosting and support may be suspended until the balance is settled.
- Payments are processed by Stripe. Launchpad does not store full card numbers on its own systems.
4. Refunds
All sales are final. Because we provide a free, fully-functional demo prior to any purchase, you have the opportunity to evaluate the quality and fit of our work at no cost or risk. Once production begins on a purchased plan, no refunds will be issued under any circumstance, including but not limited to changes of mind, business closure, dissatisfaction after launch, or third-party service interruptions. 5. Client Responsibilities
- Provide accurate business information, content, photos, and approvals in a timely manner.
- Respond to requests for feedback within 5 business days. Delays caused by lack of client response may extend timelines and do not entitle you to a refund.
- Maintain ownership and legal rights to any content (text, images, logos, video) you provide.
6. Ownership and License
Upon full payment, you own the final website content, design assets specific to your project, and any registered domain in your name. Launchpad retains ownership of our underlying templates, code libraries, design system components, and proprietary tooling, which are licensed to you on a non-exclusive, perpetual basis as part of your site.
7. Hosting and Support
Hosting is included free for 30 days after launch. Continued hosting requires an active monthly support plan or transfer of the site to a host of your choosing. We do not guarantee 100% uptime but target 99.9%. We are not liable for outages caused by third-party providers, DNS issues, or acts outside our reasonable control.
8. Revisions and Tweaks
Unlimited revisions are included during the design phase. After development begins, two rounds of polish revisions are included. Additional or out-of-scope changes are billed at our standard rate or covered by your support plan.
9. Cancellation of Support
You may cancel monthly support at any time from your client portal or billing portal. Cancellation takes effect at the end of your current billing cycle. No partial refunds are issued for the unused portion of any billing period.
10. Acceptable Use
You agree not to use Launchpad services for unlawful, harmful, defamatory, infringing, or fraudulent purposes. We reserve the right to suspend service for violations.
11. Limitation of Liability
To the maximum extent permitted by law, Launchpad's total aggregate liability arising out of or related to these Terms or any services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or business interruption.
12. Warranty Disclaimer
Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
13. Indemnification
You agree to indemnify and hold Launchpad harmless from any claims, damages, or expenses arising from content you provide, your use of the services, or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active clients via email or the client portal. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute shall be resolved through binding arbitration in Delaware, except either party may seek injunctive relief in court for IP claims.

All email inquiries are routed to our internal admin portal and personally reviewed. We respond within one business day. You can also submit questions through the contact form on our website, which routes to the same inbox.
17. Third-Party Services and Sub-Processors
To deliver the Services, we rely on the following industry-standard providers, each with their own security certifications and privacy policies:
- Stripe — payment processing (PCI DSS Level 1).
- Secure cloud backend — database, authentication, and object storage.
- Cloudflare — DNS, CDN, and DDoS protection.
- Vercel / equivalent — hosting infrastructure.
- Postmark / equivalent — transactional email delivery.
By using the Services, you consent to Client data being processed by these sub-processors solely to deliver the Services.
18. Domains and DNS
If we register a domain on your behalf, the domain is registered in your name. You are the legal registrant and owner. Renewal fees are billed by the registrar directly and are not included in any Launchpad plan. Launchpad is not responsible for expired domains if renewal fees are not paid by the Client.
19. Assignment
You may not assign or transfer these Terms or your account to another party without our written consent. Launchpad may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, with notice to active Clients.
20. Force Majeure
Neither party is liable for delays or failures resulting from causes beyond reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government action, internet outages, or provider failures affecting Stripe, backend infrastructure, DNS, or hosting.
21. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
22. Entire Agreement
These Terms, together with any written scope, order confirmation, Privacy Policy, and Refund Policy, constitute the entire agreement between you and Launchpad and supersede any prior oral or written communications on the same subject matter.
